Welcome to the TERAVARNA Foundation website (the “Site”). These Terms & Conditions (“Terms”) govern your access to and use of the Site. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

About TERAVARNA Foundation

TERAVARNA Foundation (“TERAVARNA Foundation,” “we,” “us,” or “our”) is a nonprofit public charity recognized as tax-exempt under Section 501(c)(3) of the U.S. Internal Revenue Code.

Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated “Last Updated” date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

Privacy

Your use of the Site is subject to our Privacy Policy. Please review it to understand how we collect, use, and protect information.

Site Content and Intellectual Property

Unless otherwise stated, the Site and its content—including text, design, graphics, images, photographs, illustrations, logos, and other materials—are owned by or licensed to TERAVARNA Foundation and are protected by intellectual property laws.

You may access and use the Site content for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any Site content for commercial purposes without our prior written permission.

Third-Party Names, Trademarks, and Logos

The Site may reference third-party organizations, products, or services. Such references are provided for informational purposes only.

Listing or mentioning a third party does not imply endorsement, partnership, or affiliation unless we explicitly say so.
Third-party logos and trademarks are the property of their respective owners and may not be used without permission.

If you believe content on the Site infringes your intellectual property rights, contact us at legal@teravarna.org with details.

Donations

a) Donation Processing

Donations may be processed through third-party payment providers. By donating, you agree to the payment provider’s terms in addition to these Terms. We are not responsible for third-party platform outages, processing delays, or errors.

b) Tax Deductibility

TERAVARNA Foundation is a 501(c)(3) public charity. Donations are tax-deductible to the extent allowed by law. We provide an acknowledgment/receipt for qualifying donations. Donors are responsible for consulting their own tax advisors regarding deductibility.

c) No Goods or Services

Unless explicitly stated otherwise, no goods or services are provided in exchange for donations.

d) Refunds

Donations are generally non-refundable. If you believe a donation was made in error, please contact legal@teravarna.org within 14 days of the transaction. Refund decisions are made at our discretion and may be subject to processing fees and platform limitations.

e) Recurring Donations

If you enroll in recurring giving, you authorize us (or our payment processor) to charge your payment method on a recurring basis until you cancel. Cancellation applies to future charges only.

Program Applications, Grants, and Fee Waivers

If the Site allows you to apply for grants, fee waivers, mentorship, or other support:

Submitting an application does not guarantee funding, selection, or participation.
All decisions are made at the Foundation’s discretion, subject to eligibility criteria, available resources, and program priorities.
You agree that any information you submit is accurate and not misleading.
We may request additional documentation to verify eligibility.
We may pause, modify, or discontinue programs or application cycles at any time.

User Submissions (If You Submit Text, Images, or Files)

If you submit content through the Site (including artwork images, biographies, statements, or other materials), you retain ownership of your content.

By submitting content, you grant TERAVARNA Foundation a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute your submission for Foundation-related purposes, including:

application review and administration,
program evaluation,
impact reporting,
showcasing recipients (with appropriate credit), and
promoting the Foundation’s charitable mission.

If you want certain information to remain confidential, do not submit it through public-facing forms.

Prohibited Uses

You agree not to use the Site:

for unlawful, fraudulent, misleading, or harmful purposes,
to harass, threaten, or defame others,
to upload malicious code, scrape data, or attempt unauthorized access,
to impersonate any person or entity,
to submit false or misleading information, or
to infringe intellectual property rights.

We may restrict, suspend, or terminate access for violations.

Disclaimers

The Site is provided on an “as-is” and “as-available” basis. We make no warranties that the Site will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

Content on the Site is provided for general informational purposes only and does not constitute legal, financial, or professional advice.

Limitation of Liability

To the maximum extent permitted by law, TERAVARNA Foundation shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Site, including loss of data, profits, or business opportunities.

To the extent liability cannot be excluded, our total liability for claims related to the Site shall not exceed USD $100 or the amount you donated to us in the prior 12 months (whichever is greater), except where prohibited by law.

Indemnification

You agree to indemnify and hold harmless TERAVARNA Foundation, its directors, officers, employees, contractors, and volunteers from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your submissions, or your violation of these Terms.

Third-Party Links

The Site may contain links to third-party websites. We do not control those sites and are not responsible for their content, policies, or practices. Access third-party sites at your own risk.

Termination

We may suspend or terminate your access to the Site at any time if we believe you have violated these Terms or engaged in harmful conduct.

Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any disputes arising under or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of those courts.
